According to the Occupational Safety and Health Administration (OSHA), over 13,000 deaths each year result from falls. Falls are the second most common cause of accidental death, as vehicle collisions are the number one cause. 70% of falls are due to a lack of ordinary or reasonable maintenance. Injury from a slip or trip and fall can take place anywhere. There are many locations where dangerous conditions can be encountered that result in a serious injury from a fall. If an injury causing fall is the suspected result of the negligence of another, it is extremely important to quickly act to preserve evidence and to determine the cause of the fall. Under the evidence laws, these subsequent remedial measures may or may not be admissible at trial. The obvious problem is that if the evidence is either gone or inadmissible, your case can be much harder to prove (if not impossible). Therefore, it is important to preserve evidence as soon after injury as is possible. This can include: preserving the shoes and clothing you were wearing, photographing and/or videoing the condition of the scene of injury, noting and recording the existence of any warning signs, video cameras, etc.; identifying witnesses and employees who were in the area before during or after injury; formally requesting that the potential defendants preserve specific evidence (such as videos, sweep logs, etc.)
